Terms of Service
Last updated 21 September 2026
These terms form an agreement between you and Dig n Decker (Pty) Ltd, trading as DigBid AI ("we", "us"), for your use of the DigBid AI platform at https://digbid.digndecker.co.za.
1. Acceptance
By creating an account or continuing to use DigBid AI, you agree to these terms. If you are accepting on behalf of a business, you confirm you have authority to bind that business. If you are accepting as an individual, you confirm you are of legal age to contract.
2. What the service does
DigBid AI helps South African businesses discover public tenders, assess whether to bid, track compliance documents and draft tender responses with the help of artificial intelligence. Tender data is aggregated from public government sources and is provided for convenience only.
3. Your account
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- Plans are per organisation; seat limits are stated on the plan you select.
4. Acceptable use
You must not:
- use the service unlawfully, or for fraud, spam or misrepresentation;
- infringe anyone's intellectual property or confidentiality;
- interfere with the security or integrity of the service — including malware, probing, scraping, automated bulk extraction or circumventing usage limits;
- submit or generate illegal content, deepfakes, hate speech, malware, or attempt to jailbreak the AI models or extract their system instructions;
- resell, redistribute or reverse engineer the service.
5. AI outputs and your responsibility
DigBid AI uses AI models to summarise tenders, score opportunities and draft text. AI output can be incomplete or wrong. You are responsible for your prompts, for verifying every output before you rely on it, and for holding the rights to any content you upload.
Match scores, go/no-go recommendations and compliance findings are decision support, not professional, legal, financial or procurement advice. Always confirm requirements against the official tender documents before submitting a bid. We do not guarantee any bidding outcome.
6. Content and intellectual property
We retain all rights in the platform, its software, models, branding and documentation. You keep ownership of the company information, documents and proposals you upload or generate, and grant us a limited licence to host and process them solely to provide the service.
If you believe content on the platform infringes your rights, email info@digndecker.co.za and we will investigate, remove infringing content where appropriate, and may suspend accounts for repeat infringement. We may also remove, restrict or filter content and outputs that breach these terms.
7. Plans, billing and taxes
Card payments are processed securely by our payment processor, Paystack. Dig n Decker (Pty) Ltd is the seller of record: we set prices, invoice you, handle all customer service inquiries, and manage cancellations and refunds in line with our Refund Policy.
Subscriptions are month-to-month, billed in South African Rand (ZAR), and renew automatically until cancelled. Paid plans start with a 14-day free trial; your card is stored but not charged until the trial ends. When you cancel, your access continues until the end of the period you have already paid for. Prices include VAT where applicable, and invoices are emailed after each payment.
Payment processing itself is subject to the Paystack Terms. We never see or store your full card number.
8. Service availability
We work to keep DigBid AI available and accurate, but we do not guarantee uninterrupted or error-free operation. Government tender portals occasionally change or go offline, which can delay or interrupt tender data.
9. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. On termination you may export your data for 30 days, after which it may be deleted.
10. Warranties and liability
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special loss, including lost profits, lost tenders, lost data or goodwill. Our total liability is limited to the fees you paid in the 12 months before the claim. Nothing here excludes liability for fraud, death or personal injury where the law does not permit exclusion.
You indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
11. General
These terms are governed by the laws of the Republic of South Africa, and disputes are subject to its courts. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. We may update these terms and will post the revised version here with a new "last updated" date.
